1. Introduction: - “Meadgears”. in is an Indigenous brand co-owned with “Physiotrack” to cater to the needs of customers in the Physiotherapy and Wellness Industry. It is a one-stop store for Medical Products ranging from Physiotherapy to Rehabilitation to Personal/Home Care to Hospital Used Equipment.

As an online shopping portal, we reserve the right to make any amendment at any point of time, without prior notice on the website.

1. Terms:- By subscribing/using any of the services of Medgears; “Website” , you ;“User”, agree to have thoroughly read & accepted the Terms and conditions as mentioned below,which may be revised time to time. You agree to enter into “User Agreement” with medgears.org. Please read the following terms and conditions very carefully as your use of service is subject to your acceptance of and compliance with the following terms and conditions 

III. Ordering:- At time of placing order, you need to mention complete Contact Information, Detailed Address with mandatory PINCODE, Two Contact numbers. We will not be liable for delivery to any other location apart from the mentioned Address which has to be complete in all aspects.

1. Payment:-You may use Credit cards/Debit cards, Internet Banking, UPI and Cash on Delivery to make your purchase.

(i) COD:-If you are not comfortable making an online payment, you can opt for the Cash on Delivery payment mode wherein you can pay in cash at the time of actual delivery of the product at your doorstep. The maximum order value for a Cash on Delivery payment is Rs 20,000 and an additional fee shall be applicable along with copy of Pan Card. Need to take this on account that in case of COD customer has to pay minimum amount of Rs 500 for order confirming. COD option is not offered by our Courier partners at few serviceable locations. Also, COD option is not available on some of our products. Hence, based on your location and your choice of products, COD option may not be available to you.

(ii) Credit/Debit Cards :- You can directly pay through your Debit/Credit Cards/Internet Banking/Bank Deposit/UPI at the time of Purchase. Order confirmation will be sent to you immediately and payment confirmation will be sent to you once the payment is credited to our Account.

1. Shipping & Delivery Charges:- Free Shipping for orders worth Rs 1500 and above all over India. (Heavy charges apply for certain SKUs)

Shipping and Delivery Charges for order Below Rs. 1500 may vary from location to location. 

We ship Heavy Items by ground courier through our courier partners depending on the delivery Zone. For a few remote locations where there is no other courier service available, we use India Post to deliver your orders. We deliver goods within 7 working days for the Items in Stock. Deliveries to very remote locations such as North East may take up to 15 Working Days or longer, depending on the location's geographical constraints & any external factors.

As soon as we ship your order, you receive an e-mail notification with a link to track your order.

For Items “Available” but not in stock, Estimated Delivery information is sent to the registered email id.

We ship Products only within India. We are not liable for any claims of orders from outside India.

Those who choose to access this Website from outside India are responsible for compliance with local laws if and to the extent local laws are applicable. Some Indian states prohibit direct sale of merchandise from other states and require special documentation to affect such a sale without dual taxation, if we receives an order from such states or to be delivered to such states under such circumstances we retain the right to accept or reject the order at our sole discretion. Those who choose to access this Website from Indian states which restrict such use are responsible for compliance with local laws if and to the extent local state laws are applicable. We will deliver the products only within states having open import policy and will not be liable for any claims relating to any products ordered from restricted states.

Services: For any issues / concern related to the product - Please share the details on our official WhatsApp no - +91-98188 63299. Customer has to send the product to our Warehouse for repair or replace. Please do not attempt to repair the yourself /unauthorized repair as this may cause electric shock and will also void the warranty. Outer Breakage Product, water damage, wear, and tear, batteries, medicine chamber, massage heads excluded from the warranty.

1. Warranty:-The product is guaranteed to be free from defects in workmanship and parts in the warranty period. Defects that occur within this warranty period, under normal use and care will be repaired or replaced at our discretion, solely at our option with no charge for parts or labour. 

PLEASE NOTE - Warranty Program Changes - Applicable for new users only

Purchase beyond 2022 - Not Applicable for new warranty program

Example - before 2023 - 1 year warranty is applicable for users

Equipment warranty:- It covers warranty except all breakages and consumables like: - Reagents, control, calibrator & Strips. This warranty does not extend to accessories, manuals and packaging, line cords or wiring. In warranty machine will be repaired FOC. Any replacement will be done by company after checking the equipment and its condition. “Medgears” reserves the right to replace the Product or relevant part with the same or equivalent product or part or repair it. Where a replacement is provided the Product or part replaced becomes the property of “Medgears”. We may replace parts with refurbished parts. Replacement of the Product or a part does not extend or restart the Warranty period. This warranty does not cover batteries or any other consumable item. The warranty will not apply if the company-applied serial number has been altered or removed from the Product. The warranty will not apply if damage, malfunction or failure resulting from alterations, accident, misuse, fire, liquid spillage, use on an incorrect voltage, power surges and dips, thunderstorm activity, voltage supply problems, use of defective or incompatible accessories, exposure to abnormally corrosive conditions or entry by any insect, vermin or foreign object in the Product or theft. This warranty is limited to defects in workmanship or parts. All defective products or parts will be repaired or replaced. This warranty does not extend to accessories. This warranty does not cover manuals and packaging, line cords or wiring. 

VIII. Accuracy:- All possible care is taken to display the most accurate information of the Rate, Products, Description & warranty on the website, however typographical errors may occur.

(i) Product:- Utmost care is taken to display the content in terms of description & specifications of the Product as accurate as possible. The physical dimensions of the Product are given in approximation. Actual Product may vary slightly from the Image shown as the Image colours & size may also depend on the viewer's screen. Packaging of the Product may also vary depending on your order. Our Products are manufactured at our world class manufacturing facilities in India.

(ii) Rates:- All Rates are inclusive of GST. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, we shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. In the event that an item is mis-priced, we may, at our sole discretion, either contact you for instructions or cancel your order and notify you of such cancellation. In the event we accept your order the same shall be debited to your credit / debit card account and duly notified to you by email or the contact number, as the case may be, that the payment has been processed. The payment may be processed prior to dispatch of the product that you have ordered. We strive to provide you with best value, however prices and availability are subject to change without notice. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit / debit card account. Please note, for preorders there are no cancellations or refunds allowed after orders are placed.

1. Ownership of rights:- The Sole rights of content, matter & Products on the website are with Medgears. Any Use, in form of duplication of any of the above is prohibited.

No one, apart from Medgears. reserves right to modify, transmit, produce, repost, display or utilise any commercial benefit from any content, matter or Product displayed on the website. We reserve the right to accept or reject your order in part or in full. Final Dispatch of Products will only ensure acceptance of your order. It is ensured that Dispatch of Products(s) be made within 3-7 working days. However, on occasion of any delay, which may happen due to any reason, intimation will be made in form of email on your registered email id. In case of partial dispatch, the portion of order dispatched will be deemed accepted, the pending order would be deemed accepted after complete dispatch. Cancellation is not allowed after dispatch. 

Liability:- We shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this Website. This User Agreement and any contractual obligation between us and you will be governed by the laws of India, subject to the exclusive jurisdiction of Courts in Delhi. All disputes will be subject to arbitration in Delhi by a single arbitrator appointed by us under the Arbitration and Conciliation Act, 1996. Each party to arbitration shall bear its own cost. We are and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay you any compensation for any Comments; or (3) to respond to any Comments. Unless otherwise specified herein, this Agreement constitutes the entire agreement between you and us with respect to the Websites/services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and us with respect to the Websites/services.

The User hereby consents, expresses and agrees that he has read and fully understands the Privacy Policy of Medgears The user further consents that the terms and contents of such Privacy Policy are acceptable to him.

XII. Suggestions & Restrictions:- For any change, suggestion or information in relation to the Content or Product you may write to us at medgears.surgical@gmail.com. We also invite your reviews on the products and your experience of our services. In doing so, you are not permitted to post, display or transmit any third party information, obscene, hateful, racial, unlawful or any objectionable content. We may delete any objectionable content which may threaten any matter related to individual, business, country. You can use the Website for the Sole purpose of placing an order for the Products displayed on the website & giving your reviews on the same. Any other unlawful use of the Website is prohibited and may incur Legal action, if required.

Further Use of Website for any below reason is prohibited:-                                           

• Displaying information/content that may constitute a criminal offence infringement of any relevant regulation/Law.
• Use that may interfere with service to any other user, host or network, including, without limitation, via means of submitting a virus to the Website.

XII. Usage Terms & Implication:-

• 'In Stock'
  For items listed as "In Stock", Dispatch Information will be given to you within 3-7 Working Days on your registered email id. The transit time period is based on your Pincode Location & accessibility of your region by the courier service assigned to.
• 'Available'
  Products mentioned “Available” would imply that Products might not be in stock, however will be made available in case of any confirmed order. The dispatch time will include the regular delivery period and the procurement time o the product which will be intimated time to time.
• 'Out of Stock'
  Currently, the item is not available for sale. You can contact at medgears.surgical@gmail.com  for requirement of the product.
• Preorder : Tentative Shipment dates will be as indicated on product pages. Due to logistical challenges due to Covid, please expect slight delays in dispatch and movement of goods.
